It is a matter of course for us to respect your personal rights. This also applies to the handling of personal data during your visit and use of this website. Therefore we act in accordance with the applicable data protection law. In the following you will learn how we treat your personal data and in particular which data we process for which purposes and which rights you have in this respect.
Personal data is all information relating to an identified or identifiable natural person. The basic personal date is your name. In addition, your gender, date of birth, address, occupation, e-mail address and IP address are also considered personal data. Non-personal data, on the other hand, is data with which the determination of your actual identity is impossible or at least requires considerable effort. This includes, for example, the aforementioned information if we receive it anonymously or under a pseudonym and therefore cannot assign it to any natural person.
Principle of Anonymity
When using the AMERIA Website, you remain anonymous to us as long as you do not voluntarily provide us with personal data by writing to us via our contact form or sending us an unsolicited application.
Provision of Personal Data
4.1 The provision of personal data is neither required by law nor by contract for the use of the AMERIA Website. You are not obliged to provide any personal data about yourself. However, you cannot visit the AMERIA Website without transferring the IP address you are using.
4.2 Contact with us via our contact form and sending an unsolicited application requires the provision of the data described in more detail in Sections 6 and 7. If you do not provide us with this information, you can neither use the contact form nor the option of an unsolicited application.
Processing of Personal Data
5.1 When using the AMERIA Website the following data is stored for organizational and technical reasons: the names of the webpages accessed, the browser and operating system used, date and time of access, search engines used, names of downloaded files and your IP address. We evaluate this technical data anonymously and for statistical purposes only in order to be able to continuously optimize our Internet presence and make our Internet offerings even more attractive. These anonymous data are stored separately from personal data on secure systems and do not allow any conclusions to be drawn about an individual person. The IP address is stored for one week, after which it is automatically deleted.
5.3 We have engaged various service providers to assist us in the provision, operation and maintenance of our IT systems, including the AMERIA Website. These include, for example, hardware and software suppliers, Google Inc. (for the web analytics service Google Analytics, see Section 12, and for the spam protection service reCAPTCHA, see Section 14), hosting providers and data centers. When such service providers work for us, they may be given access to your personal data as recipients. However, these service providers are then also contractually obliged to comply with data protection by means of a so-called order processing agreement; the statutory provisions on data protection also apply to our service providers anyway.
5.4 Your personal data will not be passed on, sold or otherwise transferred to third parties. Anything to the contrary shall only apply if this is necessary for the execution of the notified or agreed purposes and is permitted under applicable data protection law without consent, if you have expressly given your consent or if we are legally obliged to do so. Section 5.3 remains unaffected and applies independently of this Section 5.4
5.5 The personal data provided by you on the AMERIA Website or collected by us will not be used for automated individual decision making.
6.1 If you contact us via the contact form, you agree that your message may be processed by us together with your stated contact data for the purposes of answering and contacting you. You can also enter a pseudonym (a fictitious name) as the name. Your consent and our legitimate interest in being able to contact users of the AMERIA Website electronically form the legal basis for the processing (Art. 6 par. 1 lit. a and f GDPR).
6.2 To protect us against spam and abuse, we use a reCAPTCHA query that you must confirm and execute before you can send us a message using the contact form. Further details on reCAPTCHA and the effects on data protection can be found in Section 14.
6.4 We will only process the data you provide via the contact form to process your message and respond to you. As long as we have received your contact data, which you provide via the contact form, only for processing, contacting and answering your message, we will not use this personal data for any other purposes. Apart from cases in which we are legally obliged to do so, we will not pass on your contact data to third parties in this case.
6.5 Six (6) months after sending the reply, we delete the data transmitted by you via the contact form, unless we are legally obliged to keep it for a longer period or we still need your personal data to carry out or process an existing contractual relationship or for purposes of proof. In such a case we delete the relevant data after the legal retention period has expired or as soon as we no longer need the data for the execution or processing of an existing contractual relationship or for purposes of proof.
6.6 You may withdraw your consent at any time for the future (for contact details see Section 17 below). Your contact data will be stored after the withdrawal for as long and as far as we are obliged to do so within the scope of the legal archiving obligations or we still need your personal data to carry out or process an existing contractual relationship or for purposes of proof.
7.1 If you contact us via our unsolicited application form, you agree that we may process your contact and application data, including your CV, if any, for the purposes of processing your application and contacting you. Your consent and our legitimate interest in receiving applications and contacting applicants form the legal basis for processing (Art. 6 par. 1 lit. a und f GDPR).
7.2 To protect us against spam and abuse, we use a reCAPTCHA query that you must confirm and execute before you can send us your unsolicited application via the respective form. Further details on reCAPTCHA and the effects on data protection can be found in Section 14.
7.4 We will only process the data you provide via the unsolicited application form to process your application and respond to you. As long as we have received your contact and application data, which you provide via the unsolicited application form, only for processing, contacting and replying to your application, we will not use this personal data for any other purposes. Apart from cases in which we are legally obliged to do so, we will not pass on your contact and application data to third parties in this case.
7.5 If your application is successful and you enter into an employment relationship with us, we will transfer the contact and application data you submitted via the unsolicited application to our personnel management and your personnel file. In the event of a cancellation, we will delete your contact and application data three (3) months after sending the cancellation to you, unless we are legally obliged to keep it for a longer period, you consent to longer storage (we will ask you for this consent separately) or we still need your contact and application data to carry out or process an existing contractual relationship or for purposes of proof. In such a case, we will delete the relevant data after expiry of the legal retention period or the period agreed with you within the scope of the consent or as soon as we no longer need the data to carry out or process an existing contractual relationship or for purposes of proof.
7.6 As long as your application does not result in an employment relationship with us, you may withdraw your consent at any time for the future (for contact details see Section 17 below). Your contact and application data will be stored after the withdrawal for as long and as far as we are obliged to do so within the scope of the legal archiving obligations or we still need your personal data to carry out or process an existing contractual relationship or for purposes of proof.
Withdrawal of Consent
8.1 Subject to the statutory provisions, you are entitled to withdraw your consent to the processing of your personal data for the future at any time. To do so, please contact the office mentioned in Section 17 below.
8.2 We point out to you that the processing of your personal data, which we have carried out on the basis of your given consent until your withdrawal, is not affected by the withdrawal and remains legal.
Right of Access, Right to Rectification, Erasure, Restriction of Processing, Object and Data Portability
Subject to the statutory provisions, you have the right to obtain information from us about your personal data processed by us, as well as the right to correct, delete, restrict processing, object to processing and to data portability. The exact conditions under which you are entitled to the aforementioned rights can be found in Articles 15 to 21 GDPR and Sections 34, 35 and 37 of the Federal Data Protection Act (BDSG). If you wish to exercise one or more of the above rights, please also contact the office indicated in Section 17.

Subject to the statutory provisions, you have the right to contact the responsible supervisory authority with complaints regarding data protection. The Baden Wuerttemberg State Commissioner for Data Protection and Freedom of Information is responsible for us. 11.2 As soon as you visit the AMERIA Website, the following cookies are set:
– PHPSESSIONID: This is a cookie generated by WordPress (the software we use to administer the AMERIA Website). The cookie serves as a general identifier that is used to maintain user session variables. It contains a randomly generated number that is assigned to your browser during the browser session. The cookie is deleted at the end of the browser session.
– qtrans_front_language: The cookie saves the selection of the language in which the AMERIA Website is to be displayed (German / English). Personal data are not stored in the cookie.
– __ga, _gat_gtag_UA_670379_1 and _gid: The cookies used by Google Analytics and their meaning are described at https://support.google.com/analytics/answer/6004245?hl=en and https://developers.google.com/analytics/devguides/collection/analyticsjs/cookie-usage
11.3 If you click on one of the social media links available on the AMERIA Website, the linked website of the social network opens. From there, additional cookies may be stored on your device. These cookies are not under our control. The respective provider is solely responsible for the data protection-compliant behavior of such cookies.
11.4 The content of the cookies is encrypted (exception: qtrans_front_language) to prevent third parties from gaining unauthorized access to the data contained therein.

Use of Google Analytics
12.1 As described in Sections 12.1 et seq. in more detail, we use the Google Analytics web analytics service on the AMERIA Website. Provider is the US located enterprise Google Inc. Google Analytics analyses the data traffic on the AMERIA Website and collects various data about you and your user behavior on the AMERIA Website (e.g. which web browser you use, where you come from, which language setting you use, which search engines you use, the date and time of your visit to the AMERIA Website, how long you stay on which page). Your IP address is only collected anonymously; for details see Sections 12.2 and 12.5. Our use of Google Analytics is for the purpose of tracking user behavior on the AMERIA Website and to better understand it so that we can optimize our website and make a better offer available to users. The legal basis for our use of Google Analytics is our legitimate interest in using our website on the AMERIA Website for marketing purposes and optimizing it in line with our demands (Art. 6 par. 1 lit. f DSGVO). We delete the user data collected with Google Analytics on a rotational basis.
12.2 The AMERICA Website uses functions of the Google Analytics web analytics service. Provider is the Google Inc., 1600 Amphitheater Parkway Mountain View, CA 94043, USA. Google Analytics uses so-called cookies. These are text files that are stored on your computer and allow analyzing how you use the AMERIA Website. The information generated by the cookie about your use of the AMERICA Website will normally be transferred to a Google server in the USA and stored there.
12.3 However, in the case of the activation of the IP anonymization that we use on the AMERICA Website(see also Section 12.5), your IP address will be previously abridged by Google within the Member States of the European Union or in other Contracting States of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and abridged there. On our behalf, Google will use this information to analyze how you use the AMERIA Website, to compile reports on website activity, and to provide us with other services related to website and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be amalgamated with other Google data.
12.4 You can prevent the storage of cookies by customizing your browser software; however, we would point out that in this case you might not be able to fully exploit all functions of the AMERIA Website. 12.5 You can also prevent the collection of data by Google Analytics, which you create on the AMERIA Website and which are stored in the cookie, by activating the link below. An opt-out cookie will be stored on your computer that prevents the future collection of your data when you visit the AMERIA Website (but this does not apply to other websites that you visit and other browsers that you use on the same computer): Google Analytics deactivate. This alternative is particularly suitable for mobile devices. If you choose to do so, do not delete the opt-out cookie. Otherwise, you will lose the protection this opt-out cookie provides until you reinstall it.
12.6 Google Analytics has been extended on the AMERIA Website by the code “anonymizeIp”. The use of this code leads to an anonymous collection of your IP address by the so-called IP masking. The last octet of your IP address is set to zero from that. For IPv6 addresses, this affects the last 80 of the 128 bits. This is still done in the random access memory before the data is written to the drive (see also https://support.google.com/analytics/answer/2763052).

Use of Social Media Links
We currently do not use any social media plugins on the AMERIA Website. However, we do display social media links from the following social networks:

Use of reCAPTCHA
14.1 We use the iframe (inline frame) reCAPTCHA on the AMERIA Website to benefit from contents of the following provider:
14.2 The legal basis for our use of reCAPTCHA is our legitimate interest to make our contact form and the unsolicited application form on the AMERIA Website available only for contact by human beings and to protect us from spam and misuse (Art. 6 par. 1 lit. f GDPR).
14.3 reCAPTCHA is an online service of the US company Google, Inc. The Provider is Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. reCAPTCHA helps us to distinguish whether an input on the AMERIA Website is made by a human being or fully automatically by a machine (especially by a so-called bot). Our use of reCAPTCHA is for the purpose of ensuring that only human beings contact us via our contact form and the unsolicited application form and that we do not become a victim of spamming or fake messages. For this purpose reCAPTCHA collects various data about you and your user behavior on the AMERIA Website (e.g. your IP address, plug-ins installed in the browser, language setting of the browser, screen and window resolution, execution time, time zone, number of click / keyboard / touch actions in the iframe of the captcha). reCAPTCHA determines from which website the captcha function is called. It reads cookies already stored on your device or saves a new cookie if no reCAPTCHA cookie is available (see also Section 11). The information generated by such cookies about your use of these AMERIA Website is usually transferred to a Google server in the USA and stored there.

15.1 Google web fonts, so-called Google fonts, are used on the AMERIA Website, which require your browser to download them into its cache. To do this, your browser establishes a connection to the servers of the provider of the web fonts and transmits the IP address used by your device at this time. The provider of the web fonts thus learns that a user with your IP address visits our AMERIA Website. If your browser does not support the web fonts used by the AMERIA Website, the display is based on a standard font instead.
15.2 The legal basis for our use of web fonts is our legitimate interest in displaying texts and fonts of our web presence on the AMERIA Website correctly and independently of the system you use in order to ensure a uniform, visually pleasing presentation of our AMERIA Website on the accessing devices (Art. 6 par. 1 lit. f GDPR).
